NYC Certificate of Occupancy Help
A Certificate of Occupancy (CO) states the legal use, occupancy and number of units for a building. Buyers, lenders, insurers, tenants and licensing agencies all rely on it, and a use that does not match the CO is one of the most common problems in NYC real estate.
AM Expediting Drafting & Design Works LLC researches the CO history, checks whether the current or proposed use fits it, and coordinates the filings needed to obtain a new or amended CO.
We also help with buildings that have no CO at all, which is normal for many older buildings but still raises questions in sales and lease reviews.
Need CO help?
Send the property address, the current or planned use, any CO copy you have, and your deadline. AM Expediting will review the record and explain the next practical step.
NYC Certificate of Occupancy Services
- CO research: Pull the CO history and related filings to see what use, occupancy and units are legally approved.
- Use and zoning check: Check whether a current or proposed use fits the CO, the building code and the zoning.
- Alteration-CO filings: Coordinate the DOB NOW filing, drawings and professional review for a change in use, egress or occupancy.
- Temporary and final COs: Track open items, inspections and sign-offs needed to renew a temporary CO or obtain the final CO.
- Buildings without a CO: Review pre-1938 buildings and records, and coordinate a Letter of No Objection where DOB allows it.
- Sale, lease and license support: Explain CO status to buyers, lenders, landlords, tenants and licensing agencies.
When a New or Amended CO Is Needed
A new CO is generally required for new buildings and for alterations that change a building’s use, egress or occupancy. In DOB NOW those alterations are filed as Alteration-CO jobs, and the CO is issued after the work is inspected and signed off.
Buildings erected before January 1, 1938 were not required to have a CO for their original use. Where no CO exists and the use has not changed, DOB may issue a Letter of No Objection instead.

Common CO Situations We Review
Frequent cases include storefronts changing to a different type of business, apartments added or combined, cellars and basements used contrary to the CO, temporary COs that lapsed, and buildings where the CO lists fewer units than the owner is renting.
Many of these surface in a lender’s or buyer’s review. Knowing early whether a filing is needed saves weeks.

Frequently Asked Questions
What is a Certificate of Occupancy?
A DOB document stating a building’s legal use, occupancy and number of units.
Do I need a new CO to change my store’s use?
Often, yes, if the change affects use, egress or occupancy. The fit with the CO, code and zoning decides it.
My building has no CO. Is that a problem?
Not necessarily. Buildings erected before 1938 did not need one for their original use, and DOB may issue a Letter of No Objection where the use is unchanged.
Which boroughs do you cover?
All five: Queens, Brooklyn, Manhattan, the Bronx and Staten Island.
